Acceptance of Terms
By accessing or using Pinnacle Contractor Calculator (“the Service”), you agree to be bound by these Terms of Service on behalf of yourself and, if applicable, Pinnacle Designs, LLC. If you do not agree, do not use the Service. If you use the Service on behalf of a company, you represent that you have authority to bind that company.
Who Operates This Service
Pinnacle Contractor Calculator is operated by Pinnacle Designs, LLC.
Service Description
We provide online construction calculators and estimating tools for planning and discussion purposes. The Service is not a contractor, estimator-for-hire, or building code authority.
Estimates Are Not Bids
All material quantities, labor figures, regional pricing defaults, code-check messages, and client price outputs generated by Pinnacle Contractor Calculator (“the Service”) are estimates and planning aids only. They do not constitute a bid, quote, contract, guarantee, or offer to perform work.
Every construction project involves site-specific conditions, structural variables, code requirements, material availability, labor conditions, and unforeseen challenges that automated software cannot fully evaluate. Only a qualified contractor who inspects the job site can account for those factors and produce a binding price.
Users and their clients acknowledge that any figure produced by the Service must be independently verified, adjusted, and formally proposed by a licensed or qualified contractor before work begins. Pinnacle Designs, LLC is not a party to any agreement between contractors, homeowners, or other users and their clients.
Presenting calculator output to a client as a final price without your own review does not create any obligation or warranty from Pinnacle Designs, LLC.
Pricing, Regional Defaults & Job Variation
Regional pricing presets, ZIP-based market suggestions, and markup defaults reflect general market ranges and are starting points only. Dollar defaults load approximately 5% above typical regional averages so cross-checks are less likely to undercut qualified contractor bids. They are not a recommendation of what any specific contractor should charge, what competitors charge, or what a client should pay.
Every job is unique. Final prices may vary based on site conditions, scope of work, material selections, labor availability, timing, permits, and local market factors. Users must verify supplier pricing, subcontractor rates, and job-specific requirements before presenting numbers to clients or entering contracts.
No Professional, Engineering, or Legal Advice
The Service provides general construction math and planning tools only. It does not provide architectural, engineering, legal, tax, insurance, or financial advice.
Code-related warnings (including stair, guard, ramp, and accessibility references) illustrate common rules of thumb only. They are not a substitute for your local building official, architect, engineer, or accessibility consultant. Always confirm requirements with the authority having jurisdiction before construction.
Your Responsibility
You are solely responsible for how you use the Service, including all inputs you enter, estimates you create, and documents you share with clients or third parties.
You agree that you will not represent calculator output as a guaranteed price, code-compliant design, or professional opinion of Pinnacle Designs, LLC.
If you are a contractor, you remain solely responsible for licensing, permits, insurance, workmanship, safety, and compliance with all applicable laws and codes.
Accounts & Cloud Sync
Creating an account is optional. Core calculators and the estimate builder work without an account, saving data locally in your browser. If you create an account, you are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must provide accurate information when registering and keep it current. You may delete your account at any time by contacting us. Pinnacle Designs, LLC may suspend or terminate accounts that violate these Terms or are used for unlawful, abusive, or fraudulent activity.
Cloud-synced projects and business profile details you save are stored to provide the Service. See our Privacy Policy for details on how that data is handled.
Subscriptions, Billing & Refunds
The Service offers a free Starter plan and paid Contractor and Company subscription plans. Paid plans are billed in advance on a recurring monthly basis through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method the applicable recurring fee plus any applicable taxes until you cancel.
Prices are shown on our Pricing page and may change. We will provide notice of any price change before it applies to your next billing cycle. Your continued subscription after a price change takes effect constitutes acceptance of the new price.
You may cancel your subscription at any time from your Stripe customer portal or by contacting us. Cancellation stops future renewals; your paid features remain active through the end of the current billing period. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or features not used.
If a payment fails, we may retry the charge and may suspend or downgrade paid features until payment succeeds. We are not responsible for bank, card, or overdraft fees resulting from billing attempts.
Payment card details are handled by Stripe and are not stored on our servers. Your use of Stripe is subject to Stripe's own terms and privacy policy.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT RESULTS WILL BE ERROR-FREE.
We do not warrant that the Service will meet your requirements, that calculations are complete or suitable for any particular project, or that the Service will be uninterrupted or free of defects.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINNACLE DESIGNS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR CONTRACTS, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Pinnacle Designs, LLC and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) estimates or documents you create or share; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party, including your clients.
Governing Law & Disputes
These Terms are governed by the laws of the State of Iowa, United States, without regard to conflict-of-law principles, except where federal law applies.
Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Iowa, and you consent to personal jurisdiction in those courts.
Nothing in these Terms prevents either party from seeking injunctive relief for misuse of intellectual property where permitted by law.
General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
Our failure to enforce any right under these Terms is not a waiver of that right.
We may update these Terms at any time by posting a revised version on this page. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Plain-language summary
Our calculators help you plan — they do not replace a site visit, your judgment, or local code officials. You are responsible for what you bid and build. We are not liable for money lost because someone relied on a calculator number without checking it. The legal sections above control if there is ever a disagreement.
